Given that financial statements and other supporting information appear to be missing or non-compliant, and it is not reasonable to ask owners to vote on something without the full information they are entitled to, should the AGM should not proceed until all documentation is accurate and complete?

In short:

  • The committee sought expert advice and a professional opinion on issues raised in this question.
  • There is no ‘missing’ or ‘non-compliant’ information and the AGM documentation is in order.
  • The AGM will not be delayed and will proceed as scheduled on 15 April 2026.

During the session, the Treasurer acknowledged the concern and noted the tension between compliance and the financial pressure caused by further delay (levies already overdue, sinking fund under pressure). The Chair committed to following up with BC Systems to confirm compliance. The Secratry noted that the relevant motion is for owners to approve historical financial statements, not vote on forward matters – but acknowledged the point.

It is noted that with the exception of the Independent Auditor’s Report for FY2025 and the FY2025 audited financial statements – which are relevant only to Motion 2 in the voting paper – no information regarding what is ‘missing’ or ‘non-compliant’ was provided and has not been provided since.

Both the expert advice and professional opinions sought by the committee indicate the information provided to owners in relation to the Annual General Meeting scheduled for 15 April 2026 is in order.

We encourage owners to review the Independent Auditor’s Report and refer any questions to the committee.

We also recognise that discussion around this matter in the session and in the WhatsApp Community may have caused some owners distress. If you are concerned about any of the information provided here or in the WhatsApp community, we encourage you to contact the committee for accurate information. You can reach out privately by email or directly to any member of the committee.
